Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and 404bus (“cursor2api,” “we, ” “us”), governing your access to and use of the cursor2api desktop application, the local gateway bundled with it, the website at cursor.404bus.com, and any related activation, licensing, or support services (together, the “Service”). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Introduction and Acceptance
cursor2api is offered by 404bus, reachable at hello@404bus.com. These Terms constitute the entire agreement between you and us with respect to the Service and supersede any prior discussion, proposal, or arrangement. By clicking “I agree,” installing the application, activating a licence, or otherwise using any part of the Service, you accept these Terms on behalf of yourself and, where you are acting for an organisation, that organisation.
We may amend these Terms from time to time. Material changes will be announced at least fourteen (14) days before they take effect, either in-app, on the website, or by email to the address associated with your licence. Continued use of the Service after the effective date of a change constitutes acceptance of the revised Terms. If you do not accept a change you may stop using the Service and request a refund under Section 7 if you remain within the eligible window.
2. Service Description
2.1 What cursor2api is
cursor2api is a native macOS application that runs a local OpenAI-compatible HTTP gateway (the “cursor-proxy” sidecar) on your machine and reconfigures supported third-party AI coding harnesses to point at that gateway. Supported harnesses currently include Claude Code, Codex, OpenCode, Cline, Zed, Aider, Kilo, Continue, and Crush. The application also exposes a settings panel, a licence activator, and a diagnostic console.
2.2 Nature of the Service
The Service is delivered as a digital product with immediate access upon purchase and activation. It is not a subscription. Purchasing a licence (a “CDK”) grants a perpetual, non-exclusive right to use the current major version of the application on up to two Macs concurrently under the paid tier. Certain features remain free of charge and do not require a CDK, as described in Section 4.
2.3 Dependency on upstream AI providers
cursor2api itself does not generate AI content. The cursor-proxy sidecar routes requests from your local harnesses to a third-party backend that you designate — by default the Cursor cloud backend at cursor.sh, or an alternative endpoint you configure. Availability, pricing, and output quality of upstream AI models are controlled by those third parties and their terms govern the traffic they receive.
cursor2api is an independent utility. It is not affiliated with, endorsed by, or sponsored by Cursor, Anysphere, Anthropic, OpenAI, or any of the harness vendors named above. Trademarks referenced on the website belong to their respective owners and are used only for nominative purposes.
3. Account Registration and Eligibility
The Service does not require a traditional user account. Access to paid features is gated by a licence email address and a CDK. You must:
- be at least 18 years old and legally able to enter into a binding contract;
- provide an accurate email address at checkout, which will receive your CDK and serve as the identifier for support and refund requests;
- keep your CDK reasonably confidential; a CDK behaves like a bearer token and anyone who holds it can activate the Service on up to two devices.
You are responsible for the actions taken under any CDK associated with you. If you believe your CDK has been disclosed to an unauthorised party, contact us at hello@404bus.com and we will rotate the CDK after verifying ownership.
4. One-Time Purchase
cursor2api uses a one-time-purchase licensing model. There are no recurring charges, no automatic renewals, and no automatic top-ups.
- Free tier. The Claude Code harness, the public “endpoints” and “models” pages, and the basic diagnostics are available at no cost and do not require a CDK.
- Paid tier. A CDK unlocks the remaining harnesses, the fleet manager, model routing, and future paid features. The current price is USD 4.99 per CDK. A single CDK permits activation on two Macs at the same time.
- Device transfer. You may deactivate any device from the in-app fleet settings and re-activate a different Mac in its place. Deactivation is instantaneous. There is no cap on the number of times you may transfer, provided the two-device concurrency limit is respected.
- Version scope. A CDK is valid for the major version in which it was issued and any subsequent point releases and security patches. Future major versions may be offered as a separate purchase; if so, the pricing and any upgrade terms will be published in advance.
5. Billing and Payment
All payments are processed by Waffo Pancake, our designated Merchant of Record (“MoR”). Waffo Pancake presents itself as the seller on your receipt and statement, collects the purchase price on our behalf, and is responsible for the collection and remittance of value-added tax, goods-and-services tax, and applicable sales tax in the jurisdictions it supports. cursor2api itself does not receive card data. Waffo Pancake is PCI-DSS certified and no cardholder data is stored on our systems.
Prices are displayed in United States dollars unless otherwise indicated. Local currency amounts and tax lines shown at checkout reflect Waffo Pancake’s conversion at the time of purchase and may differ from your bank’s conversion by a small margin. The amount billed on your statement is the amount authorised at checkout; we do not add hidden fees, and Waffo Pancake’s processing costs are absorbed by us.
We may adjust the sticker price of the CDK from time to time. Price changes are prospective only and never apply retroactively to licences that have already been purchased. If a promotional price is displayed for a limited period, it will be honoured for transactions completed within that window.
Failed payments, chargebacks, and reversed transactions may result in the automatic revocation of the CDK issued for the disputed purchase. If a reversed transaction is later reinstated, we will re-issue an equivalent CDK on request. We reserve the right to decline transactions from parties associated with prior fraud, repeated chargeback abuse, or violations of Section 10.
6. Cancellation and Account Deletion
Because cursor2api is a one-time purchase there is no subscription to cancel. You may stop using the Service at any time by uninstalling the application. If you would like your activation records deleted from our systems, send a request from the email associated with the CDK to hello@404bus.com. We will confirm receipt and remove the records within thirty (30) days, subject to the retention obligations described in Section 11 and in our Privacy Policy.
7. Refund Policy
We offer a 14-day, no-questions-asked refund for any CDK. To request a refund, reply to your purchase receipt with the CDK you wish to have reimbursed within fourteen (14) days of the transaction date. The reversal is processed by Waffo Pancake back to the original payment method, typically within five (5) to ten (10) business days. Upon refund the CDK is revoked and all devices activated under it will fall back to the free tier at the next activation check.
After the 14-day window the purchase is non-refundable except where required by mandatory consumer-protection law in your jurisdiction. Because the Service is a digital product delivered immediately, some statutory withdrawal rights (for example the standard EU 14-day distance-selling right for digital content) may be waived at checkout when you consent to immediate delivery. That statutory waiver does not affect the voluntary 14-day refund described above.
8. Billing Disputes
If you believe you have been billed in error, contact hello@404bus.com before initiating a chargeback. We aim to:
- acknowledge your dispute within two (2) business days;
- reach a resolution — refund, credit, or a documented explanation — within five (5) business days of receiving all information required to investigate.
If we cannot resolve the dispute directly, we will coordinate with Waffo Pancake, who acts as the Merchant of Record and holds the settlement funds. Filing a chargeback while a dispute is still open with us may delay resolution.
9. AI Output and Intellectual Property
9.1 Your content
The cursor-proxy sidecar processes your prompts, source files, diffs, and other inputs locally on your machine and forwards them directly to the upstream provider you designate. cursor2api does not receive, store, log, or otherwise access the content of your prompts or the responses returned by upstream models. You retain all rights in your inputs and, subject to the upstream provider’s terms, in the outputs generated for you.
9.2 No training use
We do not use your inputs or outputs to train, fine-tune, or evaluate any AI model.
9.3 Our software
The cursor2api application, cursor-proxy sidecar, website copy, logos, and documentation are licensed to you under the terms published with each release. Except for the rights expressly granted, all right, title, and interest in the Service, including all intellectual property, remain with us or our licensors. Where a portion of the Service is published as open source, the applicable open-source licence governs that portion; nothing in these Terms curtails the rights those licences grant you.
You may not remove, obscure, or alter copyright, trademark, or other proprietary notices contained in or accompanying the Service. You may not use our name, logo, or trademarks in a way that suggests endorsement, partnership, or affiliation without our prior written consent.
9.4 No warranty of AI output
Upstream AI providers may generate content that is inaccurate, incomplete, biased, or otherwise unsuitable for a given purpose. We make no representation or warranty as to the accuracy, quality, or fitness for any purpose of content produced by Cursor, its models, or any other upstream provider. You are responsible for reviewing any output before relying on it, particularly in production, safety- critical, or regulated contexts.
10. Acceptable Use
You agree not to use the Service to:
- generate content that sexually exploits or endangers minors, including any material that would qualify as child sexual abuse material under any applicable law;
- create non-consensual intimate imagery, sexual deepfakes, or impersonation media of real individuals;
- develop, distribute, or facilitate the deployment of malware, ransomware, spyware, or other malicious code;
- infringe the intellectual property or privacy rights of any third party, including by scraping copyrighted works at scale or circumventing technical protection measures;
- perform automated bulk queries against upstream providers with the intent of training or evaluating a competing large-language-model product;
- reverse engineer, resell, sublicense, or share access to the paid tier beyond the two-device concurrency permitted by Section 4;
- hold yourself out as a licensed professional (medical, legal, financial, engineering, or otherwise) whose advice is powered by AI-generated content without appropriate qualification and disclosure;
- probe, scan, or attempt to breach the security of our activation infrastructure or of any upstream provider.
We may suspend or revoke a CDK, without refund beyond the amount required by law, where we have a reasonable basis to believe it has been used to conduct any of the activities listed above.
11. Data, Privacy, and Security
Our processing of personal data is described in the Privacy Policy, which forms part of these Terms. In summary:
- Prompts and outputs stay local. They never touch our servers.
- Activation data. We receive only the licence email address, the CDK, a hashed machine identifier (
sha256(IOPlatformUUID)), the application version, and a user-chosen machine name. - Payments. Cardholder data is handled exclusively by Waffo Pancake under PCI-DSS.
- Retention. Activation records are retained for up to ninety (90) days after account deletion or CDK revocation, after which they are purged. Transaction records held by Waffo Pancake may be retained longer to satisfy tax and accounting obligations.
12. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, or error-free, that upstream providers will remain available, or that AI-generated output will be accurate, up-to-date, non-infringing, or fit for the use to which you put it. You acknowledge that AI systems produce probabilistic output, that responses to the same prompt may vary between runs, and that responses may contain factual errors, hallucinated citations, insecure code patterns, or content that reflects biases present in upstream training data. You accept full responsibility for reviewing AI output before it is deployed, shared, or otherwise relied upon.
To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service — whether in contract, tort, statute, or otherwise — will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) USD 50. Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, even if advised of the possibility of those damages. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.
13. Term and Termination
These Terms remain in effect for as long as you use the Service or hold an active CDK. You may terminate the agreement at any time by uninstalling the application and requesting deletion of your activation records under Section 6. We may terminate or suspend your access if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Service. Where the Service is discontinued for reasons other than your breach, we will provide a pro-rated refund for CDKs that are less than twelve months old. Sections 9 through 15 survive termination.
14. Dispute Resolution
Before initiating any formal proceedings, please contact us at hello@404bus.com so we can try to resolve the matter directly. We commit to responding to written disputes within five (5) business days. Nothing in this Section affects mandatory consumer protection rights available to you under the law of your habitual residence.
15. General Provisions
Changes. Material changes to these Terms will be announced at least fourteen (14) days before they take effect.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
No waiver. Failure to enforce any provision does not waive the right to enforce it later.
Force majeure. Neither party is liable for failure to perform caused by circumstances beyond its reasonable control, including acts of god, war, terrorism, industrial disputes, government action, network outages, and upstream provider failure.
Notices. Legal notices to us must be sent to hello@404bus.com. Notices to you may be delivered to the email address associated with your CDK or posted in the application.
